Effect of GDPR on care home owners

Topics covered: Ridouts professional advice

As of 25 May 2018, a new law for data protection will apply in the UK and will see the enforcement of GDPR (General Dare Protection Regulation) across the European Union. Care home owners have until this date to get their data in check so that they can prove how they are protecting people’s data.

The Government repeals the current Data Protection Act (DPA) 1998 on 24 May 2018 and six principles will replace the DPA’s eight principles. They focus on accountability and will give care home owners the chance to evidence how they are protecting people’s data by demonstrating they are adhering to data privacy.

Providers need to ensure they have a clear process for managing data breaches and breaches must be notified to the Information Commissioners Office (ICO) within 72 hours.
