Further to our recent Ridout Report for January 2013 covering CQC’s issuing of a penalty notice on a provider in December, it has been revealed that CQC have issued a further two penalty notices on another provider for the amount of £4000 each.
As mentioned in the Ridout Report, this was the first time in our experience of advising providers expereincing problems with CQC that the regulator used this enforcement power. It appears that CQC may be beginning to use this power more frequently. The most likely situation that CQC may decide to serve a penalty notice on a provider is if an offence is deemed to be continuing after the timescale in a warning notice has expired.
