Joanna Sharr

Joanna is a dual qualified solicitor in New Zealand and in England and Wales, qualifying in England and Wales in 2009. Prior to joining Ridouts in 2010, Joanna advised on commercial litigation and contentious tax matters.

Since joining the firm, Joanna has advised clients facing compliance and enforcement action by the Care Quality Commission and she regularly advises on challenges to CQC compliance reports and notices of proposal. Joanna has also conducted a number of appeals against CQC’s notices of decision to the Care Standards Tribunal, including appeals against CQC decisions to cancel providers’ registrations and decisions to vary conditions on registrations.  This has included appeals in which Joanna has taken leading roles in negotiating and securing successful outcomes for our clients.

In addition, Joanna advises clients on safeguarding issues, fee disputes and contractual disputes against local authorities.

Recent cases:

  • Joanna acted for a care home provider in a fees dispute with a local authority.  Due to budget constraints experienced by the local authority, our Client had not received an increase in service user fees for over 5 years, thereby putting our client under financial strain and compromising its ability to meet the needs of its service users.  Joanna negotiated a successful outcome with the local authority by agreeing an increase in the fees paid by the local authority for each of its service users, to the satisfaction of our client.
  • Joanna acted for a care home provider which had received a decision from CQC to cancel its registration.  Joanna appealed CQC’s decision and engaged in proceedings against CQC before the Care Standards Tribunal, which included attending case management hearings and assisting with the preparation of the witness evidence.  Joanna successfully negotiated a stay of proceedings with CQC, allowing the client more time to demonstrate to CQC that they were able to sustain improvements at the service, which led to CQC withdrawing its opposition to the appeal.
  • Joanna recently acted for a provider who was threatened with prosecution by CQC for operating a healthcare clinic without being registered.  Joanna successfully identified a number of mitigating factors in defence of our client’s position which meant that our clients avoided immediate prosecution.

In her spare time she enjoys travelling, skiing and spending time in the outdoors.
