Nythan Smith

Nythan joined Ridouts in November 2013, initially as a paralegal and qualified as a solicitor at Ridouts in April 2018. 

Nythan supports clients facing a variety of issues including challenging the accuracy of inspection reports; disputing the necessity of conditions being imposed by a regulator and drafting representations to criminal prosecutions all the way up to appealing proceedings to cancel a provider’s registration.  Nythan has represented Clients experiencing contractual difficulties with commissioning authorities in, safeguarding concerns and fee disputes.

Nythan also represents Clients in preparation for and attendance at inquests in the Coroner’s court.  He is experienced in supporting clients in formulating defences to health and safety prosecutions and has spent time with Clients gathering evidence, drafting statements and instructing experts in advance of proceedings.

Nythan has also worked on cases involving health and safety prosecutions against health and social care providers as well as preparing Clients for inquests when service users die in their care.

Nythan enjoys working with clients to promote and protect their interests.

Recent cases:

  • Nythan worked with a Client to produce representations to a Notice of Proposal to cancel the registration of its nursing home. Through the gathering of detailed information and drafting of a full response reflecting the service’s true position, Nythan helped the provider to retain its registration.
  • Nythan assisted in the successful appeal at the First Tier (Care Standards) Tribunal, of a Notice of Decision issued by the CQC to cancel a Client’s registration.
  • Nythan conducted due diligence on a substantial group of care homes on behalf of the purchaser and provided as assessment of regulatory  risks involved in the purchase of the group.

Outside of work Nythan enjoys listening to music, spectating and participating in as many sports as possible, watching true crime documentaries and socialising.
