DoLs replacement bill becomes law

Legislation to replace the Deprivation of Liberty Safeguards (DoLs) received Royal Assent yesterday. The Mental Capacity (Amendment) Act 2019 was approved by the Queen after completing its journey through parliament at the end of April.

The Liberty Protection Safeguards is the name introduced as the new model for authorising deprivations of liberty in care. An implementation date has not been set in final, but Spring 2020 is likely to be the time.

In terms of practicalities, the government has confirmed that DoLs will run alongside the LPS for a year after implementation. A series of regulations and code of practice will be drafted, subject to consultation, setting out the detail of how the LPS will work.
